Course Description

This course shows how to lay the foundation for ordinances that mitigate the negative effects of sex businesses while conforming with constitutional requirements under the First Amendment. That is a short sentence but a complex topic that many local planners—and local government attorneys—do not understand. One part of this introductory course will be an overview of the modern sex businesses that have physical locations in communities. This course will also discuss the nature of "negative secondary effects," the basis on which local governments can most safely (within Supreme Court guidelines) regulate sexually oriented businesses. Once basic principles are established, there is some flexibility in creating the substance of local regulations. The second course in this series will provide specific recommendations and cautions for creating those local regulations.
